Bruce Lehrmann inquiry head engaged in ‘serious corrupt conduct’, says watchdog

The ACT Integrity Commission’s Damning Findings: A Case of Corruption and Compromised Integrity
The Australian Capital Territory (ACT) Integrity Commission has delivered scathing findings in an investigation into the conduct of Walter Sofronoff, KC, the head of an inquiry into the prosecution of former Liberal staffer Bruce Lehrmann for alleged sexual assault. Sofronoff, a former Queensland judge, was found to have engaged in serious corrupt conduct by disclosing confidential information to journalists before the official release of his inquiry’s report. This breach of trust has raised significant concerns about the integrity of the inquiry process and the fairness of its outcomes.
Sofronoff’s Actions: A Betrayal of Public Trust
The ACT Integrity Commission’s findings, released on Wednesday, revealed that Sofronoff had provided a copy of his report to two journalists, including The Australian columnist Janet Albrechtsen, prior to its public release. This action was not only a violation of confidentiality but also a deliberate attempt to influence public perception before the official publication of the report. The commission concluded that Sofronoff had “dishonestly concealed” his actions and that his conduct “significantly compromised the integrity of the inquiry.” While no findings were made against the journalists involved, Sofronoff’s behavior has been widely condemned as a clear abuse of his position and a breach of public trust.
The commission also rejected Sofronoff’s defense that he acted in the public interest to ensure the media were adequately informed. Instead, it found that he had “not, in fact, acted in good faith” and that his actions “undermined the integrity of the inquiry’s processes and the fairness and probity of its proceedings.” This undermining of the inquiry’s integrity was so severe that it threatened public confidence in the administration of justice, constituting serious corrupt conduct under the ACT’s anti-corruption laws.
The Lehrmann Case: A High-Profile Legal Drama
The inquiry into Bruce Lehrmann’s prosecution stems from a highly publicized and controversial legal case. Lehrmann, a former Liberal staffer, was accused of sexually assaulting Brittany Higgins, a former colleague, in Parliament House in March 2019. The trial was aborted in 2022 due to juror misconduct, and Lehrmann has consistently maintained his innocence. Despite this, he did not face a second trial due to concerns about Higgins’ mental health.
The case took another dramatic turn when Lehrmann lost a multimillion-dollar defamation case against Network Ten and journalist Lisa Wilkinson in 2023. Federal Court Justice Michael Lee ruled, on the balance of probabilities, that Lehrmann had raped Higgins. Lehrmann has since launched an appeal against this decision, arguing that the ruling was flawed and that he was denied a fair trial.
Findings Against Drumgold: A Question of Legitimacy
In his final report, delivered to the ACT government on July 31, 2023, but not made public until August 7, Sofronoff made a range of damaging findings against Shane Drumgold, SC, the then-ACT Director of Public Prosecutions. Sofronoff concluded that the prosecution of Lehrmann was properly brought, but he criticized Drumgold’s handling of the case. However, the legitimacy of these findings has been called into question following the revelation of Sofronoff’s own corrupt conduct.
The ACT Integrity Commission’s findings have cast a shadow over the credibility of Sofronoff’s report and the conclusions reached in his inquiry. While the commission’s report does not invalidate the entire inquiry, it raises serious questions about the fairness and impartiality of the process. This has left many wondering whether justice can truly be served when those tasked with upholding it fail to act with the integrity expected of them.
Conclusion: Lessons for Public Administration
The ACT Integrity Commission’s findings in this case highlight the importance of integrity and transparency in public administration. Sofronoff’s actions, while perhaps motivated by a desire to shape public opinion, have had far-reaching consequences that undermine confidence in the justice system. As the case continues to unfold, it serves as a stark reminder of the need for accountability and the ethical conduct of those in positions of power.
For Bruce Lehrmann, Brittany Higgins, and all parties involved, the road to justice remains fraught with challenges. The legal system must now grapple with the fallout of Sofronoff’s actions and ensure that future inquiries are conducted with the highest standards of integrity. Only then can public trust in the administration of justice be restored.
